Along with co-counsel The Employment Rights Group and John Linkosky, DHKL represents former Wal-Mart Assistant Managers in a proposed class and collective action seeking unpaid overtime wages for Wal-Mart Assistant Managers in Pennsylvania. The complaint alleges that Wal-Mart improperly classifies its Assistant Managers as exempt executives under the federal and Pennsylvania overtime laws, despite the fact that their primary responsibilities are not management, but the same tasks performed by hourly employees. Plaintiffs seek unpaid overtime wages and penalties on behalf of themselves and the proposed class. The case is called Swank et al. v. Wal-Mart Stores, Inc., 13-cv-1185-MRH (W.D. Pa.).
