DHKL, along with co-counsel, filed a proposed class action on September 5, 2013, against Ross Stores, Inc. (“Ross”) and leading janitorial contractor USM, Inc. (“USM”) alleging that they violated California Labor Code section 2810 by underfunding contracts for janitorial services resulting in systemic wage theft from janitors cleaning Ross stores in California.

On April 13, 2015, the Court preliminarily approved a class action settlement. As part of the settlement, USM has agreed to pay $1 million to current and former janitors who have provided daily maintenance services at Ross stores under a USM contract from September 5, 2009 until February 10, 2015. USM has also agreed to a monitoring system designed to ensure that janitorial subcontractors in California pay their employees at least minimum wage for performing daily janitorial services in the future.
